Botox Maker Pays Up For Illegal Promotions
BOTOX SHAREHOLDERS MUST BE FROWNING AFTER its maker Allergan agreed to pay $600 million in fines for "misbranding" the wrinkle-fighting product in sales to physicians.
Allergan "paid kickbacks to induce physicals to inject Botox for off-label uses," U.S. Assistant Attorney General Tony West said. The company also "taught doctors how to bill for off-label uses, including coaching doctors how to miscode Botox claims leading to millions of dollars of false claims being to submitted to federal and state programs."
The Irvine, Ca. company was accused of promoting its botulism-based muscle relaxer for the treatment of headache, pain, spasticity and cerebral palsy in children before they were FDA approved uses.
The probe was instigated by whistleblowers who will divvy up $37.8 million from the settlement.
